These Terms & Conditions ("Terms") govern your use of SplashUp. By downloading or using the app, you agree to these Terms. If you do not agree, please do not use the app.
SplashUp is licensed, not sold, to you. Your use of the app is also governed by Apple's standard Licensed Application End User License Agreement (EULA), available at apple.com/legal/internet-services/itunes/dev/stdeula. Where these Terms conflict with Apple's standard EULA, the standard EULA prevails with respect to Apple's requirements.
SplashUp Pro is offered as auto-renewing subscriptions (weekly, monthly, or yearly) purchased through your Apple ID. Some plans include a free trial; you will not be charged during the trial, and any unused portion of a trial is forfeited when you purchase a subscription. Payment is charged to your Apple ID account at confirmation of purchase or at the end of the free trial unless cancelled at least 24 hours before the period ends. Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage or cancel subscriptions anytime in your App Store account settings. Prices are shown in the app before purchase and may vary by region; promotional or win-back pricing may be offered at our discretion.
SplashUp is a wake-up aid and habit tool, not a medical device, and it provides no medical advice. While we work hard to make alarms reliable, we cannot guarantee that any alarm will ring or that you will wake up — device settings, battery, iOS behavior, volume, permissions, and other factors are outside our control. You remain solely responsible for critical obligations such as flights, work shifts, exams, appointments, and medication schedules. Do not rely on SplashUp as your only safeguard for anything important.
Splash and shower missions involve water. Use common sense: keep your iPhone and other electronics away from water, ensure safe footing on wet surfaces, and use appropriate water temperatures. If you have a medical condition affected by cold water exposure, consult a doctor before using cold-water features. You take part in missions at your own risk.
You agree to use SplashUp only for its intended purpose and in compliance with applicable law. You may not reverse-engineer, copy, resell, or redistribute the app; interfere with its operation; or use it in any way that could harm us, other users, or third parties.
The app, including its design, mascot artwork, sounds, text, and code, is owned by SplashUp or its licensors and protected by intellectual-property laws. These Terms grant you a personal, non-exclusive, non-transferable license to use the app on Apple-branded devices you own or control, as permitted by the App Store terms.
The app is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that it will meet your requirements.
To the maximum extent permitted by law, SplashUp and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including missed alarms, overslept obligations, lost income, or device damage — arising out of or related to your use of the app. Our total liability for any claim shall not exceed the amount you paid for the app in the twelve months before the claim arose.
You may stop using the app at any time; deleting it removes your local data. We may suspend or terminate access to the app if you breach these Terms. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) survive.
We may update these Terms from time to time. Material changes will be reflected in the "last updated" date above and, where appropriate, highlighted in the app. Your continued use after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of your country or state of residence to the extent required by local consumer-protection law; otherwise, they are governed by the laws applicable where SplashUp's operator is established, without regard to conflict-of-law rules. Nothing in these Terms limits any non-waivable consumer rights you hold under local law.
